The<a href="https://www.labour.gov.za/Pages/Default.aspx"> Employment Equity</a> Amendment Act No. 4 of 2022 (EEAA) officially comes into play on <strong>1 January 2025</strong>, following a recent announcement by the President. If your company employs more than 50 people you will need to comply.</p>
<p>Let’s break it down.</p>
<p><strong>What’s the EEAA All About?</strong></p>
<p>Signed into law back in April 2023, the EEAA introduced some significant updates to the original Employment Equity Act No. 55 of 1998 (EEA). While some changes apply broadly, most of the updates are aimed at <strong>designated employers</strong>—those with over 50 employees.</p>
<p>Here’s the big one: the Minister of Employment and Labour now has the authority to set <strong>sector-specific numerical targets</strong>. These targets will apply across 18 different sectors, and if you’re a designated employer, you’ll need to align with these.</p>
<p>So far, there have been two drafts of these sectoral targets, but nothing final yet. This uncertainty has left many industries wondering what lies ahead.</p>
<p><strong>What Else is Changing on 1 January 2025?</strong></p>
<p>Let’s get into the specifics of what’s new:</p>
<ol>
<li style="text-align: left;"><strong>Who fits the definition of a &#8220;Designated Employer?&#8221;</strong><br />
Employers with fewer than 50 employees will no longer qualify as designated employers, regardless of their annual turnover. This means <strong>Schedule 4 of the EEA</strong>—which previously allowed some small businesses with high turnover to be designated—is now repealed.</li>
<li><strong>Inclusive Definition of Disabilities</strong><br />
The term <em>people with disabilities</em> has been expanded to include individuals with <strong>intellectual or sensory impairments</strong> that may limit their access to or advancement in employment.</li>
<li><strong>Simplified Psychometric Testing Rules</strong><br />
Psychometric tests used in hiring or employment decisions no longer need certification by the Health Professionals Council of South Africa (HPCSA) or a similar body.</li>
<li><strong>Streamlined Reporting Requirements</strong><br />
Designated employers filing EEA2 reports no longer need their Chief Executive Officer’s signature.</li>
<li><strong>Sectoral Targets and Compliance</strong><br />
Compliance with the Minister’s sectoral targets will now play a role in assessing whether a designated employer is meeting their obligations under the EEA.</li>
<li><strong>Government Contracts Require <a href="https://hohr.co.za/products/hr-planner-and-guide-for-south-african-smes-for-2025/">Compliance</a> Certificates</strong><br />
Section 53 of the EEA (still awaiting full effect) adds another layer: designated employers must prove compliance with sectoral targets to secure contracts with government entities. No certificate, no deal—unless there’s a reasonable excuse for falling short.</li>

<p>With the EEAA coming into effect in just a few weeks, it’s crunch time to ensure you’re compliant.</p>
<p>For designated employers, this means taking a close look at your current processes, from equity plans to reporting practices and making sure you’re ready to meet the sectoral targets when they’re finalized.</p>

<p><a href="https://www2.deloitte.com/us/en/insights/focus/human-capital-trends-2020.html">Deloitte </a>called on organizations to look at work and the workforce through three lenses, PURPOSE, POTENTIAL AND PERSPECTIVE, —to transcend a perceived conflict between humans and technology.  Reports were completed by more than 3,600 Executives in 96 countries, which included responses from more than 1,200 C-suite executives and board members, in addition to other management functions.</p>
<p>For the first time in the report’s 11-year history, business respondents (59%), including 233 CEOs, outnumbered HR executives (41%) in the survey—underscoring the growing importance of human capital- HR in organizational decision-making.</p>
<p>This year &#8211; 2021 has shown that putting people at the heart of an organization’s decisions about work and the workforce enables leaders to better stay-ahead of disruption. Now more than ever, <em>purpose, potential, and perspective</em> are essential to build an organization that can THRIVE in an unpredictable environment with an unknown future.</p>
<p>We agree that it is time for organizations to shift their focus from a survival mindset to a thrive mindset. For leaders to <em>shift their strateg</em><em>ies</em> from preparing for the known to  preparing for the <em>unknown. </em></p>

			<p>We have been one of the fortunate small business enablers of <a href="https://hohr.co.za/human-resources-consulting/"><em style="font-weight: inherit;">Virtual consulting. </em></a>It does take time to adapt to the new way of work and design a balanced way of living. The coronavirus pandemic has forced us into the “Future world of work” sooner than anticipated, and literally, overnight, our businesses have had to shift their mindsets from “working from home” will <em style="font-weight: inherit;">never </em>work in our business to this being the “only” working contingency option available if you want to keep your doors open.</p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">We understand that not all working environments can effectively implement a Virtual working business model, it is best suited to support and administrative job functions.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">As disastrous a threat <em style="font-weight: inherit;">COVID-19</em> poses to humanity, this forced changes in the way we work in our businesses. Our view may be biased for some. We see this as an opportunity for businesses to catch up to global business practices and benefit from this progressive working model.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">We can vouch for improved efficiency experienced working virtually.  Deadlines are met. Deliverables that took days to be actioned previously may be delivered earlier or at least on time. There are fewer distractions, demands from people in and out of your office during the day, corridor gossiping, and unplanned meetings which break the momentum are no longer present. Fewer requests for time off for personal appointments. Less absenteeism. Often people leave their desks at the end of the day without having checked off anything from their “to-do” lists. Presenteeism is a behavior witnessed in most working environments and becomes a thing of the past.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">We appreciate that not all humans are self-motivated. Performance management will need to be implemented and where necessary disciplinary action is unavoidable.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">We discovered innovative apps to support virtual work, enabling us to plan ahead and have opened up a whole new world in terms of how we can market business, communicate with clients, bookkeeping, holding meetings via zoom or skype is our most often used platform to communicate “face to face” with clients.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">Our<a href="https://hohr.co.za/services/"> hands-on Virtual consulting service</a></span><span style="font-style: inherit; font-weight: inherit;"><em style="font-weight: inherit;"> has proved viable and successful in supporting small and medium businesses to thrive.</em></span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;"><a href="https://www.entrepreneur.com/businessideas/virtual-human-resources-consultant">Virtual consulting</a> has been no different from being located in the office building and e-mailing from there, accessing the HRIS, from that office, scheduling meetings online and supporting line managers with HR Best practice advice on day-to-day operations virtually and via e-mail correspondence. Now we execute these support functions virtually from our “remote office”.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">The major mindset shift is that you now need to be proactive and plan, you don’t have the luxury of quickly popping downstairs to have an invoice signed off, or approval of a policy, you now need to go paperless with online approvals.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">Leveraging technology to work smarter and optimizing this infrastructure is no longer optional. Cost savings are a no-brainer. Less traffic means less environmental impact on our planet.</span></p>
<p style="font-style: inherit;"><span style="font-style: inherit; font-weight: inherit;">Resistance to change is a major obstacle, this takes time. Establishing your new virtual working model is going to pose different challenges, see these as opportunities!</span></p>
